Terms of Service and BAC Estimation Disclaimer

Age requirement

You are at least 21 years old (or the legal drinking age in your jurisdiction, whichever is higher).

What PourTrak is

PourTrak is an informational tracking tool for adults who consume alcohol. It estimates blood alcohol content (BAC) using the Widmark formula with exponential absorption kinetics. These estimates are approximations based on population-level data and your self-reported profile.

What PourTrak is not

  • A medical device, diagnostic tool, or breathalyzer
  • A substitute for blood testing or calibrated breath analysis
  • A legal authority on impairment or driving fitness
  • Medical, legal, or professional advice
  • Protection against DUI charges or a defense in legal proceedings

BAC estimate limitations

Your actual BAC can only be measured with a breathalyzer or blood test. Estimates vary based on factors PourTrak cannot know, including but not limited to: hydration, sleep, stress, medications (prescription and over-the-counter), stomach contents, exact food composition, individual metabolism, liver function, body composition, genetics, and health status.

Estimates may be wrong by a meaningful margin. A below-threshold estimate does not mean you are below the legal limit. An above-threshold estimate does not mean you are above it.

Do not drive

Do not use PourTrak estimates to decide whether to drive, operate machinery, or make any other decision where impairment matters. If you have consumed any alcohol, the safe choice is not to drive.

Liability

You assume all risk for decisions made using information from PourTrak. PourTrak and its operator make no warranties and accept no liability for any outcome resulting from use of this service, including but not limited to: legal consequences, injury, property damage, or death.

Dispute resolution

Any dispute arising out of or relating to your use of PourTrak will be resolved through binding individual arbitration. You waive the right to a jury trial and the right to participate in a class action. Venue and law will be chosen in the operator's home jurisdiction.

Data

Your drink log and profile data are stored securely. You may export or delete your data at any time. We do not sell your data. See the Privacy Policy for details.

Disputes go through arbitration per above. By continuing to use PourTrak you accept these terms. Future TOS updates will prompt a re-acceptance.
